THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

Our Commitment to Your Privacy

Junction Health Inc ("Junction Health," "we," "us," or "our") is committed to protecting the privacy of your health information. We are required by law to:

  • keep your protected health information ("PHI") private;

  • give you this Notice describing our legal duties and privacy practices regarding your PHI;

  • follow the terms of the Notice that is currently in effect; and

  • notify you following a breach of your unsecured PHI.

"Protected health information" is information about you, including demographic information, that may identify you and that relates to your past, present, or future physical or mental health condition, the care we provide to you, or payment for that care.

How We May Use and Disclose Your Health Information

The following categories describe the ways we may use and disclose your PHI. Not every use or disclosure will be listed, but all of the ways we are permitted to use and disclose information will fall within one of these categories.

For Treatment

We may use and disclose your PHI to provide, coordinate, or manage your health care and related services. For example, we may share information with physicians, nurses, pharmacists, referring providers, and other members of your care team who are involved in your treatment, including coordinating your infusion therapy and communicating with the provider who referred you.

For Payment

We may use and disclose your PHI to obtain payment for the services we provide. For example, we may share information with your health plan to obtain prior authorization, verify coverage and benefits, or bill and collect payment for your care.

For Health Care Operations

We may use and disclose your PHI for our health care operations. For example, we may use information to evaluate and improve the quality of care, conduct training, manage and coordinate our business, perform quality assessment activities, and support administrative, legal, and audit functions.

Business Associates

We may disclose your PHI to third parties, known as "business associates," that perform services on our behalf (such as billing, IT, or messaging services). We require our business associates to appropriately safeguard your information through written agreements.

Appointment Reminders, Treatment Alternatives, and Health-Related Benefits

We may use and disclose your PHI to remind you of appointments, to tell you about or recommend possible treatment options, or to inform you of health-related benefits or services that may be of interest to you.

Individuals Involved in Your Care

Unless you object, we may disclose relevant portions of your PHI to a family member, friend, or other person you identify as involved in your care or payment for your care. We may also disclose information to notify such a person of your location or general condition.

Uses and Disclosures That May Be Made Without Your Authorization

We may use or disclose your PHI without your authorization in the following circumstances, subject to applicable legal requirements:

  • As required by law, including federal, state, or local law.

  • Public health activities, such as preventing or controlling disease, reporting to the Food and Drug Administration regarding products, or reporting reactions to medications.

  • Victims of abuse, neglect, or domestic violence, to appropriate government authorities.

  • Health oversight activities, such as audits, investigations, inspections, and licensure by oversight agencies.

  • Judicial and administrative proceedings, in response to a court or administrative order, subpoena, or discovery request, as permitted by law.

  • Law enforcement purposes, as permitted or required by law.

  • Coroners, medical examiners, and funeral directors, as necessary to carry out their duties.

  • Organ and tissue donation, to organizations that handle procurement or transplantation.

  • Research, when approved by an institutional review board or privacy board that has reviewed the research proposal and established protocols to protect your information.

  • To avert a serious threat to health or safety, to prevent or lessen a serious and imminent threat to you or the public.

  • Specialized government functions, such as military and veterans' activities, national security, and protective services.

  • Workers' compensation, as authorized by and to the extent necessary to comply with workers' compensation laws.

  • Inmates, to a correctional institution or law enforcement official if you are an inmate.

Uses and Disclosures That Require Your Written Authorization

Other uses and disclosures of your PHI not described in this Notice will be made only with your written authorization. In particular, the following generally require your authorization:

  • Marketing purposes (subject to limited exceptions);

  • Sale of your PHI; and

  • Most uses and disclosures of psychotherapy notes, where applicable.

If you provide us with an authorization, you may revoke it in writing at any time, except to the extent we have already relied on it. We will not condition your treatment on whether you sign an authorization, except in limited circumstances permitted by law.

Your Rights Regarding Your Health Information

You have the following rights regarding the PHI we maintain about you:

Right to Inspect and Copy

You have the right to inspect and obtain a copy of your PHI that may be used to make decisions about your care, in the form and format you request if readily producible. To request access, submit a written request to our Privacy Officer. We may charge a reasonable, cost-based fee. In limited circumstances, we may deny your request, and you may request a review of the denial.

Right to Request an Amendment

If you believe the PHI we have about you is incorrect or incomplete, you may request that we amend it. Submit your request in writing with a reason supporting the change. We may deny your request under certain circumstances, and we will provide a written explanation if we do.

Right to an Accounting of Disclosures

You have the right to request a list ("accounting") of certain disclosures we made of your PHI, other than disclosures for treatment, payment, health care operations, and certain other exceptions. Submit your request in writing, specifying a time period of up to six years.

Right to Request Restrictions

You have the right to request a restriction on how we use or disclose your PHI for treatment, payment, or health care operations, or to individuals involved in your care. We are not required to agree to your request, except that we must agree to a request to restrict disclosure to a health plan for payment or operations if you have paid for the service in full, out of pocket, and the disclosure is not otherwise required by law.

Right to Request Confidential Communications

You have the right to request that we communicate with you about medical matters in a certain way or at a certain location (for example, by mail to a specific address). We will accommodate reasonable requests.

Right to a Paper Copy of This Notice

You have the right to a paper copy of this Notice at any time, even if you have agreed to receive it electronically. You may request a copy by contacting our Privacy Officer.

Right to Be Notified of a Breach

You have the right to be notified if there is a breach of your unsecured PHI.

Our Legal Duties

We are required by law to maintain the privacy of your PHI, to provide you with this Notice of our legal duties and privacy practices, to follow the terms of the Notice currently in effect, and to notify you if a breach of your unsecured PHI occurs.

Where a state law (such as applicable law in Colorado) or other law provides greater privacy protection than HIPAA, we will follow the more protective law.

Changes to This Notice

We reserve the right to change this Notice and to make the revised Notice effective for PHI we already have as well as any information we receive in the future. The revised Notice will be posted in our facility and on our website at https://junction-health.com/notice-of-privacy-practices, and the effective date will appear at the top. You may request a copy of the current Notice at any time.

Complaints

If you believe your privacy rights have been violated, you may file a complaint with us by contacting our Privacy Officer. You may also file a complaint with the U.S. Department of Health and Human Services, Office for Civil Rights:

We will not retaliate against you for filing a complaint.
